1. Introduction and Definitions
1.1 This agreement ("the Agreement") is made between 4Sale-or-Let.com ("The Supplier") and the Advertiser ("You").
1.2 This agreement covers the terms and conditions under which the Advertiser places, and 4Sale-or-Let.com accepts, adverts for publication on the Web Site.
1.3 "Web Site" refers to www.4Sale-or-let.com, or to any web site controlled by the Supplier and providing a similar function.

2. Your Obligations & Rights

2.1 The description / photographs you supply are true and accurate and not misleading. 4Sale-or-Let.com does not take any responsibility for the accuracy of the information supplied and cannot be held liable.
2.2 You have obtained permission from the owner / copyright holder for any photographs used in your advert. 4Sale-or-Let.com will not be held liable for breach of copyright.
2.3 You agree to pay the relevant fees for placement of the advert, and for other goods and services supplied by the Supplier.
2.4 If you have a contract with an Estate Agent, you have independently checked your contract with regards to the terms and conditions that you must pay the Estate Agents commission. If later it is found that you are legally bound to pay the Estate Agents commission, 4Sale-or-Let.com will not be liable.
2.5 Where applicable, you will assemble the ‘For Sale’ or ‘To Let’ board complying with the local planning authority regulations.
2.6 You will inform the Supplier once the advertised property is no longer available.

3. Sale-or-Let.com’s Obligations & Rights
3.1 We will, to the best of our efforts, ensure that the Web Site is available at all times, but make no guarantees as to the Web Sites availability.
3.2 We will attempt to maintain the features on the Web Site comparable to those existing at the time the advert was accepted. We may however alter the look and or features of the Web Site without notifying the Advertiser.
3.3 We make no guarantees as to the availability of services provided by other sites, such as mapping, or partner advertising sites.
3.4 We will supply a ‘For Sale’ or ‘To Let’ board, where requested, usually within 10 working days.
3.5 We will attempt to re-advertise your property on our partner web sites within 5 working days. Publication on partner sites maybe subject to alteration or cancellation according to changes in service imposed on us by those partner sites. As such we cannot guarantee unlimited publication on these sites.
3.6 Paid adverts which have been on the Web Site for over one year will be reviewed by the Supplier, who will have the right to remove the advert.
3.7 Draft adverts which have not been paid for three months after being placed, will be reviewed by the Supplier and may be deleted.

4. Cancellation and Refunds
4.1 You may cancel this contract by informing 4Sale-or-Let.com in writing or email within 24 hours of placing the advert.
4.2 No cancellation of the advertising fee can be made after 24 hours or after you have received an enquiry in your account, whichever occurs sooner.
4.3 Cancellations for signboards and other goods supplied may be made by informing 4Sale-or-Let.com in writing or email within 14 days of receipt of the goods. The cost of returning the signboard and other goods will be borne by the Advertiser.

Liability
5.1 In no event shall the Supplier be liable to you for any loss of business, loss of opportunity or loss of profits or for any other indirect or consequential loss or damage whatsoever. This shall apply even where such a loss was reasonably foreseeable or the Supplier had been made aware of the possibility of you incurring such a loss.
5.2 Under no circumstances will our liability exceed the amount of payment received.

6. Privacy

6.1 Details of your payment card are not obtained or stored by 4Sale-or-Let.com.
6.2 Except for those property and contact deatils which you supply to be shown on your advert, we will not pass on other details collected about you to any other third party.

7 Entire Agreement

7.1 This Agreement contains the entire agreement between the parties relating to the subject matter and supersedes any previous agreements, arrangements, undertakings or proposals, oral or written.

8 Third Parties

8.1 Nothing in this Agreement is intended to nor shall it confer any rights on a third party.

9 Governing Law and Jurisdiction

9.1 This Agreement shall be governed by and construed in accordance with the law of the United Kingdom and the parties hereby submit to the exclusive jurisdiction of the British courts.
